Brexit has changed the scenario for every EEA Nationals living in the UK and the British Nationals Living in Europe. Every such individual need to refer to Appendix EU where they can find the grounds on which EU nationals and their family members and the family members of a qualifying citizen will be granted indefinite leave to enter or remain or limited leave to enter or remain in the UK. The British Nationals living in the EU will also need to do the same under Appendix EU.

EEA Nationals and their partners need to enter the UK before 31 December 2020 and register by 30 June 2021; and

The British nationals who are living in the EEA Countries can enter before 29 March 2022 to be registered under the Appendix EU.

In practice the Appendix EU rules works similarly to the EEA Regulation 2016 rules. 


Settled status & Pre-settled status- Appendix EU

Settled status means that you can live and work in the UK indefinitely. If you have lived in the UK for 5 years or more continuously you should get Settled and if you have lived in the UK for less than 5 years, then you should get Pre-settled status. Once you complete 5 years in the UK after getting Pre-settled status, you can apply for the settled status.

Appendix EU clearly defines that you need to have completed 5 years on the date of application.

If you have spent less than 5 years in the UK and you want to apply for pre-settled status: You must have started living in the UK latest by 31 December 2020 in case the UK leaves the EU with a deal or by the date the UK leaves the EU without a deal


Can you apply?

Appendix EU provides provisions for EU citizens. So, you can also apply for the settlement scheme if you are from the EU, EEA, or Switzerland or a family member of someone from the EU, EEA, or Switzerland.


Can you apply if you don't fall into the above category?

If you are not an EU, EEA, or Swiss citizen you may also apply for the scheme if you meet one of the following conditions under Appendix EU:

  • You separated from your family member who is an EU, EEA, or Swiss citizen living in the UK or he/she has died.
  • You lived with a British Citizen in an EEA country.
  • You are a family member of someone who has acquired British Citizenship now and lives in the UK, but he/she lived in the UK as an EU, EEA, or Swiss citizen earlier.
  • You are the primary carer of a British, EU, EEA, or Swiss citizen.
  • You are the child or the primary carer of the child of an EU, EEA, or Swiss citizen who used to live and work in the UK.

When can you apply?

You can apply for the EU settlement scheme before 30 June 2021 as per Appendix EU.
