Statement of Changes to the Immigration Rules - 10 September 2020

Student and child student rules are introduced in the Immigration Rules through Appendix ST and Appendix CS. The existing Tier 4 route will be closed from 5 October 2020. The main difference between the old and new route are:

  • The new rules cover EEA nationals within the student rules;
  • The new rules will permit for increased switching within the study route and within the other 'Points Based System' routes;
  • The postgraduate level studying route will no longer have an eight-year time limit.
  • Applicant Students will only need to prove the required level of English language to the Home Office once and not again and again as at present;
  • It is great to see that the new rules will no longer require applicants to meet the maintenance requirement again if they have been supporting themselves in the UK for more than a year. The Home Office is also making new rules flexible around meeting the maintenance requirement e.g. the applicant can rely on a wider range of accounts;
  • Appendix ATAS has been provided and it will set out the current Academic Technology Approval Scheme requirements;
  • The Student Dependent rules will also be contained in Appendix ST;
  • The points breakdown will be – 50 points - CAS, course requirement, approved qualification, level of study and place of study requirements 10 points - financial requirement and 10 Points - English language requirement
