Position of EU migrants at Risk with new changes to the Policy and Process

There have been changes to the policies for EU nationals in the UK. This was published by the Home Office on 01 February 2017. The policy appears to be hardening the position towards the status of EU nationals who live in the UK and do not have permanent residence in the UK, including EU national spouses of British citizens. 

If you are an EU national and came to the UK and remained in the UK without permission or entitlement for more than 3 months, then you are in breach of immigration laws. You will be unable to apply for Permanent Residence or British Nationality in such a case. 

This will mainly affect the nationals from EU8 or EU2 countries.

An EEA national must not become an unreasonable burden on the social assistance system of the UK during their initial residence. If they become an unreasonable burden they will cease to have a right of residence and can be removed from the UK in line with regulation 23(6)(a) of the Immigration (EEA) Regulations 2016.
