Regulation 26 of the EEA 2006 Regulations provides a right of appeal against refusals of EEA applications. However, the recent decision in Sala (EFMs: Right of Appeal ) [2016] UKUT 411 (IAC) the Tribunal has confirmed that there will be no right of appeals for EEA Extended Family Members. All pending appeals will simply be dismissed by the Tribunal as invalid. The only recourse available to EEA Extended Family members will be to either lodge a new application or seek Judicial Review against the refusal.
